Terms of Service

1. Acceptance of Terms

By accessing or using PromptVan ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and PromptVan. We may update these Terms from time to time, and your continued use of the Service after any changes constitutes acceptance of the revised Terms.

2. Service Description

PromptVan is a platform for managing, sharing, and discovering AI prompts. The Service includes the web application at promptvan.com, the PromptVan CLI (command-line interface), the MCP server, and the PromptVan API. These tools allow users to create, version, organize, share, and discover prompts for use with AI models.

3. Your Account

• You must be at least 16 years old to create an account and use the Service.
• You may only maintain one account per person. Creating multiple accounts to circumvent restrictions or abuse the Service is prohibited.
• You are responsible for maintaining the confidentiality of your account credentials, including your password and API keys. You are liable for all activity that occurs under your account.
• We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice in cases of severe or repeated violations.

4. Content Ownership

• Your content — You retain full ownership of prompts and content you create on PromptVan. We do not claim intellectual property rights over your content.
• License to PromptVan — By making content public, you grant PromptVan a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content as part of the Service. This license terminates when you delete the content or your account.
• Private content — Content you mark as private is only accessible to you and, if applicable, members of your team. We do not share, sell, or expose private content.
• Forking — When you make content public on PromptVan, other users may fork (copy and modify) that content in accordance with the platform's features. Forks maintain attribution to the original author.

5. Acceptable Use

You agree not to use the Service to:

• Upload, share, or distribute content that is illegal under applicable law.
• Distribute malware, exploits, or deliberately harmful code within prompts or any other content.
• Engage in spam, unsolicited messaging, or automated abuse of the Service.
• Impersonate other users, organizations, or entities.
• Engage in harassment, hate speech, threats, or discriminatory conduct toward other users.
• Circumvent rate limits, authentication mechanisms, or other security measures.

Violations of this policy may result in content removal, account suspension, or permanent termination at our sole discretion.

6. Marketplace

When the PromptVan Marketplace is available, the following additional terms apply:

• Sellers represent and warrant that all prompts listed for sale are original works and perform as described in their listings.
• Revenue from sales is split 80/20 between the creator and PromptVan, unless a different arrangement has been agreed in writing.
• Buyers may request a refund within 48 hours of purchase if the prompt does not function as described.
• PromptVan reserves the right to remove any listing that violates these Terms or is the subject of valid intellectual property complaints.

7. API & CLI Usage

• API and CLI access is subject to rate limits that vary by plan tier. Current limits are documented in your account dashboard.
• API keys are personal and must not be shared, published, or embedded in client-side code. You are responsible for any usage that occurs with your API keys.
• Automated usage of the Service (bots, scripts, integrations) must respect rate limits and may not degrade the Service for other users.

8. Intellectual Property

• The PromptVan name, logo, branding, website design, and underlying source code are the intellectual property of PromptVan and are protected by applicable copyright and trademark laws.
• Open-source components used in the Service retain their respective licenses. A list of open-source dependencies and their licenses is available upon request.
• If you believe that content on PromptVan infringes your copyright, please follow the process described on our DMCA page.

9. Termination

• You may delete your account at any time from your account settings. Upon deletion, there is a 30-day grace period during which your account can be reactivated. After 30 days, all data is permanently deleted.
• We may suspend or terminate your account for violations of these Terms. In cases of severe abuse, we may terminate immediately without prior notice.
• Upon termination, your private content is deleted. Public content that has been forked by other users may remain on the platform in anonymized form.

10. Disclaimers

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

• We do not guarantee the quality, accuracy, or effectiveness of any AI-generated output produced using prompts stored on or shared through PromptVan.
• We are not responsible for the effectiveness of any prompt for your specific use case.
• We do not guarantee uninterrupted or error-free access to the Service.

11. Limitation of Liability

To the maximum extent permitted by applicable law, PromptVan shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you have paid to PromptVan in the 12 months immediately preceding the event giving rise to the claim.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Romania, without regard to conflict of law principles. For users within the European Union, mandatory consumer protection laws of your country of residence apply to the extent they provide greater protection. Any disputes shall be resolved in the competent courts of Romania, unless EU consumer protection regulations grant you the right to bring proceedings in your country of residence.

13. Changes to These Terms

We may modify these Terms at any time. For material changes, we will provide at least 30 days' notice via email to registered users before the updated Terms take effect. Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree to the revised Terms, you must stop using the Service and may delete your account.
